Strategic advice
at every stage of a dispute

Business disputes require legal expertise, a clear understanding of the client’s business, and the ability to make timely decisions. BVA advises companies, investors, directors, officers, and executives on preventing and resolving corporate, contractual, and commercial disputes through litigation, arbitration, mediation, and strategic negotiations in Brazil and in matters involving cross-border elements.

We assess each dispute based on its legal, financial, operational, and reputational implications. Working closely with in-house legal and executive teams, we evaluate potential scenarios, establish priorities, and determine the most appropriate course of action—whether negotiation, mediation, arbitration, or litigation.

Our work begins before formal proceedings are initiated and includes risk assessments, evidence preservation, contract reviews, strategy development, and negotiations. When a dispute becomes unavoidable, we represent clients at every stage, including emergency and interim relief, discovery and evidence gathering, appeals, enforcement of judgments and awards, and debt recovery.

We have experience handling disputes among shareholders and quotaholders; claims arising from M&A transactions, including earn-out and indemnification disputes; commercial and contractual litigation; the liability of directors and officers; unfair competition and non-compete provisions; and disputes involving technology, intellectual property, financial services, aviation, agribusiness, and entertainment.

When a matter requires expertise across multiple disciplines, we draw on professionals from other BVA practices to provide a coordinated assessment of the dispute and its broader impact on the client’s business. We develop each strategy in close collaboration with the client, considering not only the proceedings themselves but also the client’s commercial objectives, reputation, and ongoing business relationships.
